Terms and Conditions

1. Definitions

• "Platform" refers to the Tool mobile application and website (tool-connect.com).
• "Client" refers to users seeking services.
• "Service Provider" refers to users offering services.
• "User" refers to both Clients and Service Providers.
• "Work Request" refers to a service request created by a Client.
• "Application" refers to a Service Provider's response to a Work Request.
• "Portfolio" refers to a Service Provider's showcase of their work.

2. Account Registration & Eligibility

• Users must register using a valid phone number for SMS verification.
• Users must be at least 18 years old.
• Service Providers must be legally eligible to offer services in the Czech Republic.
• Users are responsible for keeping their profile information accurate and up to date.
• Account sharing or creating multiple accounts by the same person is not permitted.
• Tool may suspend or terminate accounts that provide false information or violate these Terms.

3. Use of the Platform

The platform provides the following features:

• Search & Browse: Clients can find Service Providers by category, location, or language.
• Profiles: Users can create and manage profiles with relevant information.
• Messaging: Users can communicate directly through the platform and may edit or delete the messages they have sent. Edits and deletions cannot be reversed; recipients see an indicator when a message has been edited and a placeholder when a message has been deleted. Users agree to use messaging only for legitimate, service-related communication.
• Work Requests: Clients can post service requests with details, budget, and attachments.
• Applications: Service Providers can respond to Work Requests.
• Portfolio: Service Providers can showcase their work (images, videos, descriptions).
• Favorites: Clients can save Service Providers to favorites.
• Blocking: Users can block others to prevent contact.

Messages deleted by users may still remain stored temporarily in our systems for security, moderation, and legal purposes.

4. Conduct Rules

Tool reserves the right, at its sole discretion, to remove or close any content or service request that violates these Terms, appears to be spam, fraudulent, misleading, incomplete, or otherwise inappropriate. Tool may also restrict, suspend, or permanently remove accounts that repeatedly violate these rules.

5. Payments and Fees

• Tool does not process payments.
• All payments are arranged directly between Users.
• Tool is not responsible for payment disputes.
• We may introduce paid features or subscriptions in the future. Users will be informed in advance.

6. Content & Intellectual Property

• Users retain ownership of the content they upload.
• By uploading content, users grant Tool a license to use, display, and promote it within the platform.
• Tool owns all platform-related branding, design, and intellectual property.
• Users may not copy, reproduce, or misuse platform content without permission.
• Users are responsible for ensuring they have rights to the content they upload.

7. Data Protection & Privacy

• User data is stored securely using third-party infrastructure (e.g., Supabase).
• Messages may remain stored for security and moderation purposes.
• Users are responsible for protecting access to their accounts.
• We process personal data in accordance with our Privacy Policy, GDPR, and applicable Czech laws.

8. Limitation of Liability

• Tool acts only as a platform connecting Users.
• We do not provide or guarantee any services.
• We are not responsible for the quality, safety, or legality of services provided.
• Users are responsible for resolving disputes between themselves.
• The platform is provided "as is" without warranties.
• We are not liable for any direct or indirect damages resulting from use of the platform.

9. Tax Responsibilities (Service Providers)

Service Providers are responsible for:

• complying with Czech tax regulations
• reporting income
• obtaining necessary licenses or permits

Tool does not provide tax advice and is not responsible for tax compliance.

10. Reporting, Moderation & Platform Administrators

• Users can report inappropriate behavior or content.
• Tool may review, investigate, and take action where necessary.
• Moderation decisions are at Tool's discretion.
• Tool may operate verified administrator accounts, clearly marked with a "Tool Admin" badge in conversations and messages. These accounts may contact any User for moderation, support, or operational purposes and represent official platform activity.
• Administrators may receive notifications about all Work Requests posted on the platform for moderation purposes, regardless of category.

11. Account Deactivation & Termination

• Users can delete their account at any time via settings.
• Personal data will be handled according to the Privacy Policy.
• Tool may suspend or terminate accounts that violate these Terms.
• Serious or repeated violations may result in permanent bans.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the Czech Republic.
• Disputes may be resolved through mediation or arbitration in Prague.
• Consumers may use alternative dispute resolution mechanisms where applicable.

13. Updates to These Terms

We may update these Terms from time to time. Users will be notified of significant changes. Continued use of the platform means acceptance of the updated Terms.
